These Terms and Conditions set out the basis on which Rubbish Removal Ilford provides rubbish removal and waste collection services to domestic and commercial customers. By making a booking or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing an order.

1. Definitions

In these Terms and Conditions, the following expressions shall have the meanings set out below:

Customer means the person, company or organisation that requests and purchases services from Rubbish Removal Ilford.

We, us, our and Rubbish Removal Ilford refer to the provider of the rubbish removal and waste collection services.

Services means any rubbish removal, waste collection, bulky waste clearance, garden waste removal, house clearance, office clearance or similar services supplied by us to the Customer.

Waste means any rubbish, refuse, junk, debris or other materials presented by the Customer for collection and disposal as part of the Services.

2. Scope of Services

Rubbish Removal Ilford provides waste collection and clearance services within Ilford and surrounding areas. The exact scope of each service, including the type and quantity of waste to be collected, will be agreed at the time of booking based on the information supplied by the Customer.

We will collect and transport Waste to appropriately licensed facilities for reuse, recycling, recovery or disposal, in accordance with applicable waste regulations. We reserve the right to refuse to remove items that we reasonably believe are hazardous, prohibited, unsafe to handle, or not accurately described by the Customer.

The Services do not include cleaning of the premises beyond basic sweeping of the area from which the Waste is removed, nor do they include repair of any damage not caused by our negligence.

3. Booking Process

3.1 The Customer may request a quotation or make a booking by telephone, email or other contact methods that we make available from time to time. All bookings are subject to availability and acceptance by us.

3.2 When requesting a quotation, the Customer must provide accurate and complete information about the location, type, approximate volume and access conditions of the Waste to be collected. Quotations are based on the information provided and may change if the actual Waste or access conditions differ.

3.3 A booking is confirmed only when we have accepted the Customer’s request and provided confirmation. We may provide confirmation verbally or in writing. We reserve the right to decline any booking at our discretion.

3.4 For larger clearances or commercial work, we may request a site visit or photographic evidence before confirming the booking and the final price.

4. Estimates, Pricing and Additional Charges

4.1 Any prices or estimates given before our arrival are based on the details provided by the Customer and are not binding if those details are inaccurate or incomplete. Final pricing is normally determined on site once the Waste has been assessed by our staff.

4.2 Our charges may be based on volume, weight, labour time, access conditions and disposal costs. We will explain the basis of our pricing to the Customer at the time of booking or on arrival.

4.3 Additional charges may apply where:

a. The quantity or type of Waste differs significantly from that described at the time of booking.

b. Access is restricted, requires extra labour or equipment, or involves lifting or carrying beyond what was reasonably expected.

c. The collection involves items that incur higher disposal costs, such as mattresses, fridges, tyres, electrical equipment or other specialist waste.

4.4 If additional charges are required, we will inform the Customer before commencing the work. If the Customer does not accept the revised price, we reserve the right to cancel the service or adjust the scope of work. A call-out or cancellation fee may apply where our staff have already attended the property.

5. Payments and Invoicing

5.1 Unless otherwise agreed in writing, payment is due on completion of the Services on the day of collection. We accept payment methods as advised at the time of booking, which may include cash, debit card, credit card or bank transfer.

5.2 For commercial Customers or larger projects, we may agree alternative payment terms, including deposits or account arrangements. Any such arrangements must be agreed in advance.

5.3 We reserve the right to require full or partial payment in advance for certain bookings, including weekend work, large clearances or where access or parking costs are expected.

5.4 If payment is not made when due, we may suspend or cancel further services and charge interest on overdue amounts at the statutory rate until payment is received in full. The Customer will be liable for any reasonable costs we incur in recovering overdue payments.

5.5 Ownership of any Waste removed passes to us only once full payment for the Services has been received, unless otherwise stated in writing.

6. Cancellations and Rescheduling

6.1 The Customer may cancel or reschedule a booking by contacting us as soon as possible. We ask for at least 24 hours notice before the scheduled collection time.

6.2 If the Customer cancels or reschedules with less than 24 hours notice, we may charge a cancellation fee to cover our reasonable costs, including staff, vehicle and administrative expenses.

6.3 If our team arrives at the agreed location and is unable to gain access, or if the Waste is not available for collection as arranged, we may treat this as a late cancellation and charge a call-out or cancellation fee.

6.4 We may cancel or reschedule a booking at any time if we are unable to provide the Services due to circumstances beyond our reasonable control, including but not limited to severe weather, traffic incidents, vehicle breakdown, staff illness or changes in law or regulation. We will notify the Customer as soon as reasonably practicable and offer an alternative date or a refund of any amounts paid for Services not yet provided.

7. Customer Responsibilities

7.1 The Customer is responsible for providing accurate information at the time of booking, including a correct address, contact details, description of the Waste and any relevant access information such as parking restrictions, stairs, narrow entrances or security requirements.

7.2 The Customer must ensure that there is adequate access to the Waste for our staff and vehicles. Any required parking permits or parking payments at or near the collection address must either be arranged by the Customer or reimbursed to us.

7.3 Unless otherwise agreed, the Waste should be easily accessible and, where possible, grouped together to facilitate safe and efficient removal. If we are required to bag or gather loose items or move items from different locations within the property, additional labour charges may apply.

7.4 The Customer warrants that the Waste presented for collection does not contain any hazardous or prohibited materials unless previously disclosed and accepted by us. Hazardous materials may include, but are not limited to, asbestos, chemicals, solvents, oils, gas bottles, clinical waste and certain electrical or electronic items.

7.5 The Customer must ensure that children and pets are kept at a safe distance from the working area during the collection to minimise any risk of accident or injury.

8. Waste Regulations and Duty of Care

8.1 Rubbish Removal Ilford operates in accordance with applicable UK waste management legislation and regulations. We will transport Waste only to authorised facilities for treatment, recycling, recovery or disposal.

8.2 Where required, we will produce a waste transfer note or other documentation to evidence the lawful transfer and handling of the Waste. The Customer may be asked to provide or confirm certain details so that the documentation is accurate.

8.3 The Customer acknowledges their duty of care relating to Waste and agrees to cooperate with us so that we can discharge our obligations under waste regulations. This includes giving accurate information about the type and source of the Waste.

8.4 We reserve the right to refuse to collect any items that we reasonably believe to be illegal, hazardous, contaminated or in breach of waste regulations. In such cases, we may charge a call-out fee and any associated costs.

9. Liability and Limitations

9.1 We will exercise reasonable skill and care in providing the Services. However, we shall not be liable for any loss, damage or expense arising out of or in connection with inaccurate or incomplete information provided by the Customer, restricted access, or any failure by the Customer to comply with these Terms and Conditions.

9.2 While reasonable care will be taken when removing Waste from a property, the Customer acknowledges that minor scuffs, marks or wear may be unavoidable, especially where large or heavy items are being removed from confined spaces. We shall not be responsible for such minor cosmetic damage unless caused by our negligence.

9.3 We shall not be liable for any loss of profits, business interruption, loss of opportunity or any indirect or consequential loss suffered by the Customer arising from the provision or non-provision of the Services.

9.4 Our total liability to the Customer in respect of any claims arising out of or in connection with the Services, whether in contract, tort or otherwise, shall not exceed the total amount paid or payable by the Customer for the specific Services giving rise to the claim, except where such limitation is not permitted by law.

9.5 Nothing in these Terms and Conditions shall exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited.

10. Insurance

10.1 Rubbish Removal Ilford maintains appropriate insurance cover in respect of public liability and, where applicable, employer liability, in line with industry practice for waste collection and clearance services.

10.2 Details of our insurance cover may be made available to Customers on reasonable request.

11. Complaints and Dispute Resolution

11.1 If the Customer is dissatisfied with any aspect of our Services, they should contact us as soon as possible, providing full details of the issue and any supporting information.

11.2 We will investigate complaints in a fair and timely manner and aim to reach an amicable resolution. Where appropriate, we may offer to return to the property to address the issue or provide a partial refund or discount on future services.

11.3 If a dispute cannot be resolved directly between the parties, either party may pursue their rights through the courts as set out in the Governing Law clause below.

12. Force Majeure

12.1 We shall not be in breach of these Terms and Conditions nor liable for any delay in performing, or failure to perform, any of our obligations where such delay or failure results from events, circumstances or causes beyond our reasonable control. These may include, but are not limited to, severe weather, accidents, road closures, fuel shortages, strikes, acts of terrorism, pandemics, or changes in law or regulation.

12.2 In such circumstances, we will use reasonable endeavours to notify the Customer and to resume the Services as soon as reasonably practicable.

13. Data Protection and Privacy

13.1 We collect and process personal information necessary to manage bookings, provide the Services and handle payments and enquiries. This may include names, contact details, addresses and payment information.

13.2 We will take reasonable steps to keep personal data secure and to use it only for legitimate business purposes connected with the provision of our Services or as required by law.

13.3 By making a booking, the Customer consents to the collection and use of their personal data for these purposes. We do not sell personal data to third parties.

14. Amendments to Terms

14.1 We may update or amend these Terms and Conditions from time to time to reflect changes in our services, business practices, legal requirements or for any other valid reason.

14.2 The version of the Terms and Conditions in force at the time of the Customer’s booking will apply to that booking. We recommend that Customers review the latest version before making a new booking.

15. Severability

15.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision shall be deemed deleted, and the remaining provisions shall continue in full force and effect.

16. Governing Law and Jurisdiction

16.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the laws of England and Wales.

16.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services provided by Rubbish Removal Ilford.
